Explanations For Your Questions About Personal Injuries
Personal injury law is very complex, and trying to navigate it while you are also recovering from an injury is very difficult. At Dang Law Group, we work with clients in Austin and throughout Travis County to explain the many details involved in a personal injury claim. Here, our personal injury lawyers have answered some of the most common questions that we hear from our prospective clients.
How long do I have to file a claim?
In Texas, you have up to two years from the date of your injury to file a lawsuit. If you miss this deadline, you forfeit your right to recover compensation through civil action.
What damages can I seek?
Damages, or the monetary compensation awarded to plaintiffs for the breach of a certain duty, come in many forms. The most common include:
- Hospital bills
- Prescription medications
- Physical therapy
- Automotive repairs
- Loss of income
- Loss of earning potential
- Pain and suffering
You might find that you have insurmountable expenses and a loss of earning potential after an accident. If so, you can seek damages through an insurance claim or civil suit.
Is there a limit to monetary damages?
There are three types of cases where Texas caps the amount of compensation you can recover:
- Medical malpractice claims (capped at $750,000)
- Claims against government entities (capped at $500,000)
- Claims for punitive damages (capped at $750,000)
For most catastrophic injury cases, though, the state does not cap damages.
How much is my claim worth?
A variety of factors influence each unique case. Some of these factors include your hospital bills, predicted future medical expenses, lost wages and loss of earning potential. If your injury occurred at work, you might also have the right to workers’ compensation benefits. The best way to receive an accurate assessment of your claim is to speak with a personal injury lawyer.
