How long do I have to file a claim?

In Texas, you have up to two years from the date of your injury to file a lawsuit. If you miss this deadline, you forfeit your right to recover compensation through civil action.

What damages can I seek?

Damages, or the monetary compensation awarded to plaintiffs for the breach of a certain duty, come in many forms. The most common include:

  • Hospital bills
  • Prescription medications
  • Physical therapy
  • Automotive repairs
  • Loss of income
  • Loss of earning potential
  • Pain and suffering

Is there a limit to monetary damages?

There are three types of cases where Texas caps the amount of compensation you can recover:

  • Medical malpractice claims (capped at $750,000)
  • Claims against government entities (capped at $500,000)
  • Claims for punitive damages (capped at $750,000)

For most catastrophic injury cases, though, the state does not cap damages.

How much is my claim worth?
